Collections Law
Collections Law Attorney in Rockford, Maryland
Whether you are an individual who loaned money to your brother-in-law, or a small business that has provided goods or services but not been paid by your customer, a collections law attorney can help you obtain what you are owed.
We will take our direction from you; e.g. are you willing to accept a partial payment, or a payment plan? Our first step would normally be negotiating with the debtor. But we will not be led on endlessly. Having an attorney involved usually motivates action on the part of the debtor. Litigation is our business, and we do not hesitate to pursue our clients' rights in court.
If the loan is secured by a note, the drafting of the note will affect your ability to collect. Are there conditions for payment or amount? Exactly what was to be provided, and what are the terms of payment?
Filing a Claim
Small claims court is an effective and efficient system, but only for amounts up to $5,000. Filing in court is necessary for larger amounts, and may be the only way to get a judgment upon which you can collect. Frequently a debtor does not show up and a default judgment is issued. If the debtor does appear and makes a defense, the judge will render a verdict soon after the hearing.
Judgments
Once you have a judgment in hand, you can enforce it in various ways. If you know where the debtor's assets are located, you may obtain assistance from a sheriff to collect from these sources. If the debtor is employed, you may garnish wages.
